I believe the assumption that he 'owned' the rights came from the media at the time calling Étienne his own label with regards to the reissue of the album (which was actually BMG in reality).
Harvest Records is owned by Capitol and that's probably how they had 'ownership' after the mess that...
The biggest hurdle has always been Morrissey's expectation of a label rather than the actual finding of said. I don't believe anything has changed in that department?

From what I can gather, it would appear RSD UK was via Warners (Parlophone) and the EU was going to be via Universal - they oversold the UK copies and as a result the EU lost out.
