His Honour John Weeks QC​

It is with much regret that we report that Master Weeks (His Honour John Weeks QC) sadly died on the Easter weekend, aged 82. The Inn’s flag will fly at half-mast on Monday 19 April 2021, in his memory.

Master Weeks was called to the Bar in 1963 and took Silk in 1983. In 1991 he was appointed a circuit judge on the Western Circuit and as a Chancery Circuit judge in 1997 until his retirement in 2006.

He was elected a Judicial Governing Bencher in 1996.

Details of any funeral and/or memorial service will be circulated as appropriate in due course.

And it's "devious truculent snd unreliable WHEN HIS OWN INTERESTS WERE AT STAKE..."

For what it's worth , I think it WAS the intention of a 40/40/10/10 split BUT the lack of anything to confirm this was DOWNFALL of Moz and Marr

Cant imagine many band members agreeing to that split when starting out not knowing how it is going to work out (or not)
 
Judge Dread, whose now dead, should have not been weak, he made a legal error. Morrissey should have got the lot. True.
 
So 4 of you play a gig. You'd expect 25%
4 of you do a TV appearance. You'd expect 25%
T shirt sales (a shirt with all 4 of you on it) you would expect 25%

I dont see how any other % could be used between 4 members of a band.

Baring royalties everything else should have been 25%

Different scenario to 4 unknown lads getting together to form a band - but no - however, sportsmen / woman all have a contract and sign it so they are happy with what they have.

I’m pretty sure it was a gentleman’s agreement, or in this case, a ... charmingman’s agreement between the band members.

Mike uncharmingly broke that agreement.
 
The legal error was that there was one given talent (since proven by a solo career) the extras could have been anyone. (Since proven also) Tell me the names of Eric Claptons band? Exactly.
Morrissey and Johnny Marr were The Smiths and they are the nicest members and are most honest and have integrity. Morrissey is a true star with a very successful solo career he is a brave man and a beacon of hope in these dark times.

An unequal split is not uncommon in bands where there is a main songwriter/partnership and a band of contracted players. Everyone thought the Smiths were a band like the Beatles but they were definitely not, they were a songwriting partnership first and foremost with supporting players.

It's a story of perspective.
On the one hand, M and M should have had the most, that is just a fact, jack. To think otherwise is
attach to the Smiths , the same kind of logic as paying 1940s factory workers who fit different parts of the car

Its not about if they all play on a song and they all take the stage together. It's not that basic.
Marr did the bulk of the music and a number of interviews, and at the time, provided the Smiths with "Street Cool"
Morrissey did nearly everything else. he was the spirit that channeled another dimension, he wrote the songs, he created the "smiths world", he did most of the interviews, he designed the covers (not that you would guess that with the crap he puts out these days)
He picked the pre gig music and back drops. He took the blows from the press and private life troubles that came with it

So, you would have to be completely unaware of the music business in general and The Smiths in particular to give the verdict Weeks did

On the other hand , Weeks pretty much hit the nail on the head when it comes to Morrissey, he is the things he said he was. To think otherwise is also to,again, not have a clue about the Smiths


By the way that article about the Mexican fan base the other day is pathetic and shows once again most Americans, bless them, really don't get The Smiths or they do but its a completely false John Hughes version.
Also, going by what that guy said you would think Mexicans never heard of Marc Bolan, The KInks , Bowie , Lou Reed , Iggy Pop etc etc .
It was dumb, a Mexican. Amerian shoe horning pop history (and Morrissey ) to fit his jackboot .

I think this guy is one of those, and among the Mexican hardcore, there are army. Who actually think Morrissey is Mexican. Missing the point that Morrissey is one of the most English of pop stars ever.

Which would be fine, IF they had bothered to get that agreement between the four members in writing. They didn't, hence they lost.

Maybe they were naive, maybe they were excessively greedy to want 80% of the split between them (both Moz and Marr would have been raking in loads more than the other two due to publishing royalties anyway), but ultimately they have no one but themselves and the complete car crash of the band's lack of management to blame. All this should have been agreed, signed and dealt with before 'Hand in Glove' was released. I have no sympathy for them whatsoever.
 
10 per cent of a lot is better than 25 per cent of nothing.greed will come in the end.
if the court case never happened then the 75 million reunion dough if it happened split four ways would be £18.75 million,hindsight is a wonderful thing.
